1. Acceptance of Terms

By purchasing services from Monoscale, you ("Client," "User") agree to abide by these Terms of Service ("ToS"). If you do not agree, please do not use our services.

2. Services Provided

• Web Design & Development: One-time purchases unless additional services are required.
• Branding: Logo and brand identity design as a one-time service.
• Website Hosting & Maintenance: Subscription-based services.
• Ongoing Work: Available on a contract basis for continuous projects.

3. Payments & Fees

3.1 Milestone Payments (25% Each Phase)

• 25% due upfront before work begins.
• 25% due after the initial design phase.
• 25% due after development completion.
• 25% due upon final project delivery.

3.2 Payment Methods

Payments are accepted via Stripe (additional payment options may be added later).

3.3 Late Payments

If a client fails to make a milestone payment, Monoscale reserves the right to pause the project until payments are received.

4. Refunds & Cancellations

4.1 No Refund Policy (With Admin Fee Exception)

Due to the nature of our services, we do not offer refunds once work has begun. If no work has been started after the initial payment, the client is eligible for a partial refund, minus a 15% administrative fee to cover consultation, planning, and time allocation.

4.2 Cancellations

Clients may cancel a project before completion. However, a cancellation fee of 25% of the total project cost will apply if cancellation occurs after work has begun. If more than 50% of the work is completed, no refunds will be provided.

5. Intellectual Property & Ownership

5.1 Ownership Rights

Upon full payment, the client receives full ownership rights to the final website, branding, and other deliverables. Monoscale retains the right to showcase completed work in its portfolio.

5.2 Licensing & Restrictions

Clients may not resell, distribute, or claim authorship of Monoscale's work unless explicitly agreed upon in writing.

6. Client Responsibilities

• Providing necessary content, images, and assets on time.
• Ensuring legal ownership of any materials provided.
• Reviewing and approving milestones in a timely manner.

7. Hosting, Uptime & Limitations

7.1 Hosting with Vercel

Websites are hosted using Vercel, and we provide best-effort uptime based on Vercel's service availability.

7.2 Backups & Data Responsibility

Clients are responsible for keeping backups of website files and data unless subscribed to a maintenance plan.

8. Privacy Policy & Data Collection

8.1 Data Collection

Monoscale collects personal data via the contact form, including:

• Full Name
• Phone Number
• Email Address
• Project Details

9. Legal Compliance & Governing Law

These Terms of Service are governed by the laws of California, USA. In case of disputes, both parties agree to attempt negotiation or mediation before legal action.

10. Limitation of Liability

Monoscale is not liable for third-party hosting failures, client misuse of the website, or security breaches due to client mismanagement.

11. Amendments & Updates

Monoscale reserves the right to update these Terms of Service at any time. Clients will be notified of significant changes.
